A PLANNING agreement has cleared the way for the reinstatement of sluicing in Hayle and the creation of a fund to operate the harbour.
Cornwall Council this month gave formal planning consent for the development of South Quay, which has been derelict for three decades.
The historic quay will soon feature 30 homes, a waterside restaurant, a public open space and a food store.
Under the terms of the planning agreement, which has taken months to complete, developer ING has agreed to fund a number of beneficial projects for the town worth about £8.8 million to offset the impact of the plans on Hayle's infrastructure.
Cornwall Council planning officer Dave Slatter, who worked out the Section 106 agreement with the town council, ward councillors and ING, said the agreement secured the harbour's future.
He said: "Hayle is getting not just the infrastructure of the harbour repaired in and around South Quay, but also a levy which will provide a funding stream for the harbour.
"Another benefit is the harbour management being taken out of private control and into the control of a community body."
Mr Slatter said the type of community body running the harbour would be decided after a public consultation.
The consent also includes a planning obligation which requires ING to finish repairs to Hayle's historic harbour walls, reopen part of the historic Carnsew Dock and repair and reinstate the sluicing infrastructure to Carnsew Pool.
ING will further establish a World Heritage Site levy on the development at South Quay, and on other development sites within its ownership, which can be used to operate and maintain the harbour into the future.
ING community development officer Gary Cartmell said the agreement was a result of hard work and co-operation between the different parties.
He said: "It is thanks to councillors John Pollard and John Coombe, and the town councillors, who have all worked really hard.
"I think from everyone's point of view what we want is a successful harbour, because it defines Hayle and everyone has come together to see how we can achieve that ... . This means we now have a legal document discussing the future management of the harbour. It is very good news for Hayle and everyone involved."
Other benefits to the town in the planning agreement include:
â New lease arrangements for local fishermen;
â Highway improvements to Foundry Square and Carnsew Road;
â Enhanced bus stops and information systems;
â A local employment scheme;
â Affordable housing, education and primary healthcare contributions.
